COUNCIL MEETING - SPECIAL
Thursday, June 28, 2007 5:30 P. M.
A special meeting of the Common Council of the City of Weirton, Hancock and Brooke Counties, West Virginia was held on Thursday, June 28, 2007 at 5:30 P.M. in Council Chambers of the City of Weirton Municipal Building.
Mayor Miller called the meeting to order.

Mayor Miller led the Pledge of Allegiance.
OLD BUSINESS
Mayor Miller commented, “We have a change in our menu tonight, for whatever reason. I don’t know what took place between the City Clerk and the City Administration’s Secretary. Here’s the new agenda. Under Old Business we’ll reconvene the Canvass Board. That’s Item 1. Item 2 is the second reading of Ordinance 1528. Number 3 is the second reading of Ordinance 1529. Number 4 is the second reading of Ordinance number 1530. Under New Business, item number 1 is a resolution to enter into contract for tee-shirts. Item 2 is an Ordinance adopting the recommendations of the Weirton Planning Commission. Item 3 is an Ordinance amending the City of Weirton Traffic Control Map. Item 4 is an Ordinance amending the City of Weirton Traffic Control Map No. 214. Item 5 will be Communications, Prayer and then Adjournment. So, we’ll go back now and under Old Business, City Clerk.”
Mr. Maher commented, “OK. What we would like to do today is reconvene the Canvassing Board to certify the General Election, City of Weirton Municipal Election of 2007 which took place on June 12 of 2007. The Board of Canvassers met, and we do have the results of that. I did pass that out to Council, but I will go over that for the record.”
Motion to reconvene the Canvassing Board was made by Councilmember Dalrymple, second by Councilmember Moore.
The motion passed by majority, 6/0
Mr. Maher commented, “The first item of business that I will go over will be the Council race results for Ward 1 City Council. In the number of votes, Ronnie D. Jones received 413 votes. Charlie W. Mitchell, Jr. received 173 votes, for a total of Ward 1 votes of 586.
Ward 2 City Council; Norman McClements received 333 votes. Harold E. Miller, Jr. received 365 votes, for a total of Ward 2 votes of 698.
Ward 3 Council; Fred S. Marsh received a total 505 votes. Dale Moore received a total of 182 votes, for a grand total of 687.
In Ward 4, George E. Ash, Sr. received 174 votes. George E. Vacheresse, Jr. received 146 votes, for a total of 320 votes.
Ward 5 Council; George J. Kondik received 565 votes. Jonathan D. Brown received 377 votes, for a total of Ward 5 votes of 942.
Ward 6 Council; David W. Dalrymple received 512 votes. David Dalrymple was unchallenged in that race, so total Ward 6 votes were 512.
Ward 7 Council Race; Max T. Fijewski received a total of 524 votes. Frank N. Veltri received 390 votes, for a total of Ward 7 votes of 914.
Moving on to the Mayor’s Race, I can go by ward if you like, or I could actually just read the totals.”
Council Members commented, “Totals. Just read the totals.”
Mr. Maher commented, “Totals. OK. William M. Miller received 1,413 votes. Mark E. Harris received 3,368 votes, for a total number of votes of 4,781.
For the 2 Charter Amendments, for Amendment Number 1 which was Ordinance number 1407, which provided for the appointment of an Acting City Manager. Total votes for the amendment were 3,100, and total votes against the amendment were 1,263.
For Amendment Number 2; Ordinance number 1519, which would give City Council the authority to discharge appointed officers by a two-thirds majority vote. For the amendment total votes were 2,885. Against the amendment were 1,358.
That’s all of the numbers gentlemen.”
Motion to accept the vote totals as certified by the canvass, was made by Councilmember Moore, second by Councilmember Dalrymple.
Councilmember Moore commented, “Just one comment. I’d like to thank the Ballot Commissioners, Bill Moss and Kitty Kochman and our City Clerk Tom Maher, a long, tiring, thankless job, but completed, as usual, accurately and with professionalism. So, thank you for your efforts.”
Mr. Maher commented, “Thank you.”
Mayor Miller commented, “Again, thanks from the Mayor as well as the rest of the Councilmen.

ORDINANCE NO. 1528: (Second Reading) AMENDING ARTICLE 331.01 OF THE CODE OF THE CITY OF WEIRTON (ADOPTION OF STATE LAW).
Motion was made by Councilmember J. Miller, second by Councilmember Veltri.
The motion passed by majority, 6/0.
ORDINANCE NO. 1529: (Second Reading) AMENDING THE TEXT OF THE UNIFIED DEVELOPMENT ORDIANCE (UDO) AS RECOMMENDED BY THE WEIRTON PLANNING COMMISSION.
Motion was made by Councilmember Moore, second by Councilmember J. Miller.

ORDINANCE NO. 1530: (Second Reading) AMENDING THE TEXT OF THE CITY OF WEIRTON CODE OF ORDINANCE PART IX, SECTION 909.01, A PROVISION MAKING HEDGES, TREES, OR OTHER PLANTS WHICH OBSTRUCT MOTORISTS’ VIEWS A NUISANCE.
Motion was made by Councilmember Veltri, second by Councilmember Moore.

NEW BUSINESS
Resolution: TO ENTER INTO CONTRACT FOR THE PURCHASE OF TEE SHIRTS AND SWEATSHIRTS FOR THE PUBLIC WORKS DEPARTMENT EMPLOYEES.
Motion was made by Councilmember J. Miller, second by Councilmember Dalrymple.
Councilmember Kondik commented, “John, in your resolution, you were asking for $2,720.”
Mr. Brown commented, “Yes.”
Councilmember Kondik commented, “In the paperwork, it shows that it’s only $2,356.”
Mr. Brown commented, “Well, there was a correction there, because, actually, in the…when we had costs, we left out the electricians. So, again, they were overlooked, and then we added the electricians for the actual cost plus a few extra shirts for the temp services who run behind the sanitation trucks. So, that was for the extras. And, I corrected that with…Valerie brought that to my attention.”

ORDINANCE NO. NEW: ADOPTING THE RECOMMENDATIONS OF THE WEIRTON PLANNING COMMISSION REGARDING THE ZONING MAP CLASSIFICATION OF A CERTAIN PARCEL LOCATED AT BOX 263 JOHN STREET.
Motion was made by Councilmember J. Miller, second by Councilmember Moore. The motion passed by majority, 6/0
ORDINANCE NO. NEW: (EMERGENCY READING) AMENDING CITY OF WEIRTON TRAFFIC CONTROL MAP ORDINANCE NO. 214, ESTABLISHING A NO PARKING ZONE ON A PORTION OF SOUTH 20TH STREET.
Motion was made by Councilmember Dalrymple, second by Councilmember Moore.

COMMUNICATIONS
Mayor Miller commented, “This being my last Council meeting as Mayor, I wish to extend my sincere thanks to City Manager Gary DuFour and to all Council Members, Departments Heads and city employees for a job well done. This administration in the past four years has put the city on a path to progress which includes economic development, upgrading of our public safety forces and their equipment, along with many infrastructure improvements. And, I hope that the new administration will continue to carry the banner into the future for the betterment of our community. I thank everyone that’s here this evening that I work with, and also you too, Gio (Gio Rossi, Weirton Daily Times). You’re a rookie, but you’re learning the trade. And, George, (George V.) you’ve always been here. I tell you what. A council meeting would not be a council meeting without you being here. That’s all I have to say. Thank you. Go ahead, Councilman Moore.”
APPLAUSE
Councilmember Moore commented, “I also would like to thank the staff of the City of Weirton. We’re part time employees. We come in. We get our packets every week. We come in once a month. But, they’re here day to day. They do the day to day work of the city. I can’t say that I’ve ever come before one of them that they didn’t give me the time, respect, effort and deliver every answer that I asked for. Some of them maybe I didn’t agree with. Some maybe I didn’t like. But, you respect their professionalism. They’re excellent employees. I don’t believe the citizens of this city understand how good they have it to have staff like they have here in the city. I also would like to say, I am proud and privileged to have served with the men on this council. We have taken…and the administration, and Gary DuFour. We have had three owners of our primary employer in town. Our primary employer is still the primary payer of our budget. We have overcome radical shifts in the city employment. We have taken on and developed a fleet replacement plan to try to update the city’s capital resources. We have invested in infrastructure, the ATAD project, the streets, the streets of the City of Weirton. I’ve never worked with a more professional group. God knows we have disagreed, some of us have vehemently disagreed, but we have always been professional. We have never drug it in. We have never made a vote because of a grudge. We put it aside when it came to what’s best for the city. I’ve enjoyed the four years I have spent here. I have learned an immeasurable amount. And, I would like to thank each of my colleagues, each of the city staff, each of the city attorney, city judge, city manager. Life is experiences, and I wouldn’t trade the last four years and this experience for anything. Thank you all.”
APPLAUSE
Councilmember Jerry Miller commented, “First of all, I’d like to thank both the City Council, the Mayor, the City Manager and all the employees of the City of Weirton also, because the last 25 months have been definitely a learning experience. And, it’s been a privilege and an honor to serve both the Ward 1 constituents as well as the City of Weirton. And, the things that we’ve done as a Council here, I believe as Dale and the Mayor both have said, I think every time we’ve voted, we’ve always voted with the people in mind first. And, again, it’s been a privilege, and I thank you.”
Councilmember Veltri commented, “I think Councilman Moore has said it all already. I don’t know if there’s anything else I can say here. But, I want to thank everyone that I’ve worked with. It was a pleasure working with everybody. That’s about all I have to say. It was really nice working with everyone. So, thank you everyone.”
