SPECIAL COUNCIL MEETING

MINUTES

FRIDAY, MAY 27, 2005



Meeting called to Order



Councilman in Attendance:

Councilman DeMasis

Councilman Miller

Councilman Moore

Councilman Dalrymple

Councilman Veltri

Councilman Kondik



City Official in Attendance:

Gary DuFour, City Manager

John Yeager, Jr., City Attorney

Valerie Means, Finance Director

Lance Scott, Police Chief

Brae Bryant, Public Works Director

John Brown, Superintendent of Streets



Brenda Maul of the Chamber of Commerce was also in attendance.



Mr. DuFour, City Manager, requested to Convene into Executive Session consistent with WV State Code 6-9A-4 (4) to discuss litigation and personnel matters.

It was moved by Councilman Kondik and second by Councilman DeMasis to Convene into Executive Session.



The motion was unanimously accepted.



Mayor Miller asked for a motion to reconvene.



Councilman Moore moved and second by Councilman Dalrymple and it was unanimously accepted.







NEW BUSINESS



Mayor Miller said that there would be a change in the venue to entertain a motion from the floor to change Item 2 to Item 1; Item 3 would be Item 2; and Item 1 will now become Item 3.

It was moved by Councilman Moore and second by Councilman Dalrymple to accept the change in venue. There were no questions or comments.



The motion was carried unanimously.





Item 2, which is now Item 1)

Ordinance to Contract for Emergency Repairs to the Lee Avenue Bridge Without Letting Project for Bid.

It was moved by Councilman Moore and second by Councilman Dalrymple to approve this Ordinance. There were no comments or questions.



The motion was carried unanimously.





(Item 3, which is now Item 2)

Resolution to Authorize City Manager to Enter Into Contract for City-Wide Road Striping Utilizing State Purchasing Contract.

It was moved by Councilman Dalrymple and second by Councilman DeMasis to accept. There were no questions or comments.



The motion was carried unanimously.





(Item 1, which is now Item 3)

Nomination of Candidate to Fill Vacancy in Ward 1 Council Seat.

Councilman Kondik submitted the name of Jerry Miller to fill the seat in Ward 1, and second by Councilman Veltri. There were no questions or comments.



The motion was carried unanimously.



Mayor Miller commented that they had now elected Jerry Miller as the new Councilman. The Mayor and Council thanked the nine (9) individuals who submitted their name for this particular seat. The Mayor was glad to see so much participation of the public to fill the empty seat on the Council.



Mayor Miller swore in Jerry Miller as the new Councilman of Ward 1.



The Mayor also commented that Mr. Miller had big shoes to fill. That Steve Dorich was a dedicated and a loyal individual who put forth a lot of time and effort and energy in giving to the City the best of his ability. He is sure that Jerry will do the same. So again he and Council welcomes him aboard. Mayor Miller continued, speaking to the press, that they are going to have a lot of fun with this, because they are going to call the Council, "The Miller Council". They now have three (3) Miller's: Harold "Bubba" Miller, Jerry Miller, and the Mayor Bill Miller, and so anytime each of you say something in the paper, just use Miller, then no one will know who said what.

Mayor Miller thanked everyone for being there.
