A regular meeting of the Common Council of the City of Weirton, Hancock and Brooke Counties, West Virginia was held on April 07, 2006 at 7:00 P.M. in Council Chambers of the City of Weirton Municipal Building.

COMMUNICATIONS
Mayor Miller commented, “This is for the press for the ninth time this year. We would like to state that pot holes, pot holes in the City that do belong to the State Road Commission are Cove Hill, Colliers Way, Three Springs, Pennsylvania Avenue, and Culler Road. We seem to get a lot of calls from citizens concerning pot holes in these areas, and we have contacted the state numerous amount of times and sometimes they respond and sometimes they don’t. And, when they do respond, within two days, if we have rain freeze and ice, the cold patch does not take. Fortunately, within the next couple weeks, the hot asphalt plant will open, and they will be able to make better repairs to the state roads or the roads that they are in charge of. So, again, Dave, if you could, kind of highlight that. We’ll continue to accept their calls, but at the same point in time, we have to funnel the information back to the Department of Highways in either Brooke or Hancock Counties, whatever area it’s in.”
Councilmember H. Miller commented, “I’d just like to add that last year we did have Culler Road paved. The state did that, and also a large section of Pennsylvania Avenue. So, they are responding to some of our needs. But, I agree with the Mayor. There’s eight streets in the City of Weirton that belong to the State of West Virginia.”
Mayor Miller commented, “Thank you Councilman. April 30th is yard waste pick up. I believe we talked about it, no the 15th. April 30th is yard waste and Councilman Kondik wants…”
Councilmember Kondik commented, “Twelve years I’ve been…twelve years I’ve been asking to have moved up two weeks or the beginning of April, and it doesn’t seem that anybody wants to do it. So, I know that we have a container at public works. Where’s John Brown?”
Mr. Brown commented, “Right here.”
Councilmember Kondik commented, “There’s a container at public works that if somebody needs to throw their yard waste they have the availability of a dumpster at public works that they can throw their waste in.”
Mr. Brown commented, “Well, I’ve now secured public works. The gate is locked. So, it could be done…”
Councilmember Kondik commented, “Until five.”
Mr. Brown commented, “…seven and three…”
Councilmember Kondik commented, “Seven and three. Correct.”
Mr. Brown commented, “But not after those hours.”
Councilmember Veltri commented, “We want to make sure also that Spring Clean Up begins what, the week of the 16th John?”
Mr. Brown commented, “We start this Thursday on white goods, Monday through Friday on general furniture and household.”
Councilmember Veltri commented, “Thank you.”
Councilmember Kondik commented, “Thank you Mayor.”
Mayor Miller commented, “You’re more than welcome Councilman.”
CITIZEN COMMENTS
Mr. Mike Sponogle 3717 ½ West Street Extension, Weirton, WV: Mr. Sponogle commented, “Good evening ladies and gentlemen. (Unintelligible) Number one, Mayor, is I called down here complaining about a bunch of refuge and a reports ex…well Magistrates Powell’s ex property owned by Joe Tomaselli in the alleyway back there. And, as of this week, it’s still there. It’s been there for three months. Now, I guess I have to wait till city clean up to get it cleaned up, because there’s been no action taken against the landlord to make him clean the trash up. I took a picture of it before I left, and you can see it. It’s still there. It’s been there for three months, all winter.”
Mayor Miller commented, “How about showing Rod? Where’s he at? Back in the corner. Show it to Rod, and he’ll take action on it.”
Mr. Rosnick commented, “What is the address?”
Mr. Sponogle commented, “3721 West Street Extension. The property is owned by Joe Tomaselli, which last time I had to call law enforcement on him cause he did repair work to his house, and he threw it on my property, all the junk.”
Mr. Sponogle commented, “The other thing I’d like to talk to Council about is on April 1st, my son Michael Sponogle, called the Weirton Police Department because he had a domestic issue at approximately 2:30 in the morning. He has a woman living with him that is supposed to be his fiancé. Well, evidently, she’s got some guy shacking up with her in his own house that he worked with. So, he came home from out, being out on the night, whatever, walked in the house, she started to verbally abuse him and slap him in the face. So, he called the authorities. He walked out of the house, called the authorities. He waited for the Weirton Police PD Department to respond, but they didn’t show up. It was cold out, so he figured they weren’t going to come, so he started to walk down to his mother’s house down here. And, he went down past Rumorz and the police officers pulled him over and picked him up and asked him what he was doing, why he was crying and running. They arrested him for public intox. The very next day, I talked to Betty Bauer on the telephone in Magistrate’s Court, cause he’s been trying to get this woman out of his house for the past couple months. She told me to tell him because, that for him to change the locks on his doors when she left, which he did. When he came home from work that day, whenever he changed them that afternoon, and when he came from work at 5:00 this woman’s boyfriend was there babysitting her two children, in his home. He got home at 5:00. He walked out of the…the gentleman walked out of his house, stuck him with her two kids. So, he changed the locks on the door at 5:30, walked to my house with the two children. My wife was talking to him for a little while. He walked the two children down to Subway where this lady’s employed, dropped the two children off to her and told her that your babysitter left, so called babysitter left. And, I’m not your built in babysitter for your children. I’ve asked you to leave. She left on St. Patrick’s Day and cleaned his house out, and then she came back. So, anyways, he told her, and by the way, he said, I talked to the Magistrate and for you to get your belongings, you will have to get a police officer to escort you to my house to get your personal belongings. She comes to the Weirton Police Department and screams abuse, that she’s afraid. Abuse. The police officers did no investigation of any abuse or taking her to the hospital or to check her or her kids for abuse. They marched her right up to Magistrate Powell, and he swore a warrant out. It wasn’t a warrant, but a domestic thing for him, protective order. The police come at 10:00. My son’s asleep in his house, cause my wife drove him up at 9:00. There was nobody there. Asleep in his house, trying to sleep cause he has to work at 5:00 in the morning. And, the police kicked his basement door in and threw him out of his own house! And, to this day, he’s living with me now. The woman was supposed to show up in court last Thursday. Her excuse for not showing up in court was she didn’t have a ride. Well, she had a ride from the city police department to make the complaint. Why did she not get the city police department and this officer who took her up there to take her up to court Thursday? That’s wrong! I’ve talked to Tim Ennis. I’ve talked to Senator Bowman. And, I’m going to advise you all right now. It’s wrong what was done. Your police officers here are uneducated and don’t know the proper procedure, and I’m getting an attorney, and there’s going to be a civil suit filed against the City of Weirton, the magistrate’s office and the whole works, and we’re taking you to court. You violated my son’s constitutional rights of rights of privacy by kicking his door in. And, I don’t care what Magistrate Powell says, there was no investigation. If that woman was so afraid of being abused, they have a place for battered and abused women that they could have took her until they served papers on him and not kicked him out of his own house. And, I rest my case, because I am getting an attorney, and there will be a civil matter filed on these charges.”
Mayor Miller commented, “Well, thank you for your comments. Chief, do you have anything on this in addition that you can add to?”
Chief Scott commented, “Most of what the gentleman is talking about is…I agree with some of it, not all of it. How old is your son Mr. Sponogle?”
Mr. Sponogle commented, “He’s 34.”
Chief Scott commented, “OK. He’ll have to get the attorney sir.”
Mr. Sponogle commented, “Well, I’m going the hire the attorney for him.”
Chief Scott commented, “That’s fine.”
Mayor Miller commented, “Well, case closed on that. You can hire the attorney and you can move on from there. OK.” OLD BUSINESS
Ordinance No. 1521: (Third Reading) AUTHORIZING THE ACQUISITION AND CONSTRUCTION OF ADDITIONS, BETTERMENTS AND IMPROVEMENTS TO THE EXISTING PUBLIC SEWERAGE SYSTEM OF THE CITY OF WEIRTON AND THE FNANCING OF THE COST THEREOF, NOT OTHERWISE PROVIDED, THROUGH THE ISSUANCE BY THE CITY OF NOT MORE THAN $5,000,000 IN AGGREGATE PRINCIPAL AMOUNT OF SEWER REVENUE BONDS, SERIES 2007 A (WEST VIRGINIA SRF PROGRAM); PROVIDING FOR THE RIGHTS AND REMEDIES OF AND SECURIY FOR THE REGISTERED OWNERS OF SUCH BONDS; AUTHORIZING EXECUTION AND DELIVERY OF ALL DOCUMENTS RELATING TO THE ISSUANCE OF SUCH BONDS; APPROVING, RATIFYING AND CONFIRMING A LOAN AGREEMENT RELATING TO SUCH BONDS; AUTHORIZING THE SALE AND PROVIDING FOR THE TERMS AND PROVISIONS OF SUCH BONDS AND ADOPTING OTHER PROVISIONS RELATING THERETO

ORDINANCE NO. 1522
AN ORDINANCE TO EFFECTUATE THE PURPOSES SET FORTH IN SECTION 33-17-9a AND 33-17-9b OF THE WEST VIRGINIA CODE WHICH PROVIDES THAT IN CERTAIN FIRE LOSSES, AN INSURANCE COMPANY SHALL TRANSFER FROM THE INSURANCE PROCEEDS TO A DESIGNATED OFFICER OF THE MUNICIPAL CORPORATION IN WHICH THE FIRE OCCURRED, THE INSURANCE PROCEEDS AS SECURITY AGAINST THE TOTAL COSTS OF REMOVING, REPAIRING OR SECURING THE DAMAGED BUILDING; AND ALSO PROVIDING FOR ANY COSTS EXPENDED IN EXCESS OF SUCH PROCEEDS TO BE ASSESSED IN THE FORM OF A REAL ESTATE LIEN.
WHEREAS, it is in the intent of the City Council to deter the commission of arson and related crimes, to discourage the abandonment of property and to prevent blight and deterioration; and
WHEREAS, the West Virginia Legislature did enact Sections of the West Virginia Code which provide that upon notice given within six (6) months of the date of loss in accord with the referenced statute, in certain fire losses, the Insurance company shall transfer the insurance proceeds to a designated officer of the municipal corporation in which the fire occurred, insurance proceeds as security against the total costs of removing, repairing or securing the damaged building; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEIRTON:
Section 1. That the City of Weirton is hereby authorized to utilize the procedure described in W.Va. Code '33-17-9a and '33-17-9b whereby no insurance company doing business in the State of West Virginia shall pay a claim of a named insured for fire damage to a structure located within the City of Weirton where the refuse, debris, remnants or remains of the dwelling or structure have not been cleaned up, removed or otherwise disposed of and should the municipality provide statutory notice and incur the expense of such clean-up and removal, the insurance company shall pay the proceeds of such policy to the municipality in accord with the statute.
W.Va. Code '33-17-9a provides notice of claims that the municipality requires and reads as follows:
A. Upon notice of a claim of an insurance total loss to a structure located in this state, insurance companies must notify the insured, and the municipality or county in which the structure is located, of any coverage in the insurance policy providing cleanup, removal of any refuse, debris, remnants or remains of the dwelling and appurtenances and securing the structure. The notification shall be by letter to the insured, mailed within ten days of the notification of the claim and shall include, but not be limited to:
(1) The terms and limits of coverage designated by the insurance policy for securing cleanup and removal; and (2) Any time limitations imposed on the insured for securing, cleanup and removal. (See W.Va. Code '33-17-9a.)
W.Va. Code '33-17-9b provides the process which shall be utilized by the municipality and reads as follows:
B. No proceeds shall be paid by an insurance company which has issued a policy which provides coverage for debris removal for cleanup, removal of refuse, debris, remnants, or remains of a dwelling or structure upon a claim of total loss unless and until the insurance company receives certification that the refuse, debris, remnants, or remains of the dwelling or structure have been cleaned up, removed or otherwise disposed of. In the event the insurance company receives, within six months of the date of loss, certification that such cleanup, removal or disposal costs have been incurred by a municipality, county or other governmental entity, rather than the policyholder, such debris removal and cleanup proceeds shall be paid to the municipality, county or other government entity which has incurred such costs.
No insurance company subject to this section which complies with this section may be held liable for any claim that may arise out of the cleanup, removal or disposal of debris pursuant to this section.
An insurance company subject to this section which complies with this section shall be deemed to have fully satisfied all contractual obligations to the policyholder regarding debris removal.
In no event shall an insurance company be required to pay moneys in excess of policy limits for debris removal. (See W.Va. Code '33-17-9b.)
C. Nothing in this ordinance shall be construed to prohibit the municipal corporation and the named insured or insureds from entering into an agreement that permits the transfer of funds to the named insured or insureds if some other reasonable disposition of the damaged property has been negotiated and evidenced by a signed agreement between the insured and the municipality.
D. The Chief Code Official is designated as the officer authorized to carry out the duties of this ordinance pertaining to notice as well as any necessary orders effectuating the cleanup, removal or disposal of dwelling structures subject to the pertinent Sections of State Code stated herein.
E. Should the municipality undertake any debris removal for clean-up removal of refuse, debris, remnants, or remains of a dwelling structure occur, at any time, and the cost of such remediation either not be recoverable from the insurance proceeds or be in excess of such proceeds the City shall have the authority to place an assessment lien upon the property in addition to any and all other available civil and criminal legal actions. In the event any expense or costs are incurred pursuant to this ordinance, when any such expense or costs over and above proceeds of any insurance shall be assessed against the real estate. Such assessment shall bear interest at ten percent (10%) per annum and shall be immediately due and payable. If such assessment is not paid within thirty days after the same is made, the City Clerk may certify the amount of any such assessment with a description of the property chargeable therewith, and the name of the owner thereof, to the Clerk of the County Commission of the County to be recorded in the trust deed books of such Clerk=s office; also such assessment shall be and constitute a lien against such property.
Section 2. That the clerk of this Council is hereby directed to forward a certified copy of this ordinance to the Insurance Commissioner of the State of West Virginia; the Assessor of Hancock and Brooke Counties, West Virginia; the Auditor of the State of West Virginia; and the State Fire Marshall,.
Section 3. That it is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements.
This Ordinance shall become effective thirty (30) days following passage.

Resolution: SUPPLEMENTAL RESOLUTION PROVIDING AS A PRINCIPAL AMOUNT, DATE, MATURITY DATE, REDEMPTION PROVISION, INTEREST RATE, INTEREST AND PRINCIPAL PAYMENT DATES, SALE PRICE AND OTHER TERMS OF THE SEWER REVENUE BONDS, SERIES 2007 A (WEST VIRGINIA SRF PROGRAM), OF THE CITY OF WEIRTON; APPROVING AND RATIFYING THE LOAN AGREEMENT RELATING TO SUCH BONDS AND THE SALE AND DELIVERY OF SUCH BONDS TO THE WEST VIRGINIA WATER DEVELOPMENT AUTHORITY; DESIGNATING A REGISTRAR, PAYING AGENT AND DEPOSITORY BANK; AND MAKING OTHER PROVISIONS AS TO THE BONDS.
Motion was made by Councilmember J. Miller, second by Councilmember Moore.
Councilmember Moore commented, “I believe this is just more statistical detail, cost detail about the bond issue that we just approved the third reading for. Is that correct?”
Mr. Collins commented, “Yes, Councilmember Moore. This is basically, the supplemental resolution is contemplated by the ordinance because, at the time you start the ordinance, we don’t know exactly how much the bond is going to be, and some of the other details, such as the closing date. Now, we know that, and the supplemental resolution just embodies those exact amounts, $4,199,404.00, I think it is, and the other terms of that that I told you. It basically nails down the final terms.”
Councilmember Moore commented, “And, I would like to comment again. These are the kinds of projects that aren’t ticker tape parade and don’t look like home runs, but you can’t expand your business base, you can’t support your residential base without being able to produce water and process sewage. As impossibly offensive as it may be, it’s a fact of life. If you can’t provide water and you can’t process waste at a reasonable rate, and plan for future expansion and capacity, you can’t grow. I support this whole heartedly. We have other improvements (unintelligible).

Mayor Miller commented that Item 2 had been pulled off of the docket. Resolution: OF THE COUNCIL OF THE CITY OF WEIRTON AUTHORIZING PARTICIPATION IN THE NORTHERN PANHANDLE HOME CONSORTIUM FOR THE PERIOD OF JULY 1, 2007 TO JUNE 30, 2008.
Motion was made by Councilmember Veltri, second by Councilmember H. Miller.
Councilmember Moore commented, “Just, Gary confirm, this participation gets us our match money for our First Time Homebuyers Program.”
Mr. DuFour commented, “Yes, the Home Consortium handles the First Time Homebuyer Program for the entire Northern Panhandle. The City puts up a dollar amount and it’s matched dollar for dollar. So, it extended the amount we have available to make First Time Homebuyer mortgages and down payment assistance.”

RESOLUTION
A RESOLUTION OF THE COUNCIL OF THE CITY OF WEIRTON AUTHORIZING PARTICIPATION IN THE NORTHERN PANHANDLE HOME CONSORTIUM FOR THE PERIOD OF JULY 1, 2007 TO JUNE 30, 2008
WHEREAS, Title II of the National Affordable Housing Act of 1990 provides for the creation of the HOME Investment Partnership Program (hereinafter referred to as AHOME@); and,
WHEREAS, the HOME regulations promulgated by the U.S. Department of Housing and Urban Development (HUD) under 24 CFR part 92 authorizes units of general local government to enter into Housing Consortium Cooperation Agreements; and,
WHEREAS, there is a need throughout the Northern Panhandle of West Virginia to provide affordable housing for the low and moderate income residents; and,
WHEREAS, the City of Wheeling, City of Weirton, County of Brooke, County of Hancock, County of Ohio and County of Marshall, West Virginia, have formed a Consortium which has been designated as a Participating Jurisdiction under the HOME Program, thereby entitling the Consortium to an annual funding; and,
WHEREAS, the City of Weirton entered into a three (3) year Cooperation Agreement with an annual renewal clause for participation in the Northern Panhandle HOME Consortium; and,
WHEREAS, the U.S. Department of Housing and Urban Development has awarded the Northern Panhandle HOME Consortium a HOME grant in the amount of $552,824 for Fiscal year 2007; and,
WHEREAS, the City of Weirton recognizes the need to obtain funding for affordable housing and has identified the HOME Program as a source of funds to meet this need.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF WEIRTON, BROOKE AND HANCOCK COUNTIES, WEST VIRGINIA, that:
The City of Weirton will continue to cooperate with the City of Wheeling, the Counties of Brooke, Hancock, Ohio and Marshall in a Consortium for participation in the HOME Program.
The City Manager of the City of Weirton is hereby authorized to enter into a one-year renewal of the Cooperation Agreement for the period of July 1, 2007 to June 30, 2008 with the other Members which form the Northern Panhandle HOME Consortium.
A copy of this resolution is to be submitted in the request to HUD to approve funding of the Northern Panhandle HOME Consortium for the above Fiscal Year 2007 HOME Investment Partnership Program.

RESOLUTION
TO AUTHORIZE CITY MANAGER TO ACCEPT THE WV DIVISION OF JUSTICE SERVICES DIRECT AWARD THROUGH COLLABORATION WITH THE HANCOCK COUNTY COMMISSION AND PROVIDE THE ASSOCIATED CASH MATCH TO CONTINUE TO PROVIDE FUNDING FOR PERSONNEL SERVING ON THE HANCOCK, BROOKE, WEIRTON MULTIJURISDICTIONAL DRUG TASK FORCE
WHEREAS, the City of Weirton has been notified by the WV Department of Military Affairs & Public Safety, Division of Criminal Justice Services of a federal appropriation spearheaded by the Honorable Senator Robert C. Byrd; and,
WHEREAS, this notification included a Direct Award through the Justice Assistance Grant (JAG) Program; and,
WHEREAS, Hancock County has also received a Direct Award; and,
WHEREAS, the Division of Criminal Justice Services has allowed and encouraged local Direct Award recipients to collaborate by pooling direct allocations and requesting additional funding through a Competitive Award process to fund projects that meet funding criteria and are within program areas; and,
WHEREAS, the Hancock, Brooke, Weirton Multijurisdictional Drug Task Force has been instrumental in reducing the number of drug-related crimes in the Weirton area, as well as being a major part of many drug-related arrests over the past several years; and,
WHEREAS, continued funding of personnel serving on the Hancock, Brooke, Weirton Multijurisdictional Drug Task Force is vital to the area’s crime-fighting efforts.
WHEREAS, collaborative efforts and competitive award applications under the Division of Criminal Justice Programs must fall under one (1) jurisdiction; and,
WHEREAS, it has been determined that Hancock County and its Sheriff’s Department should be the jurisdiction responsible for making application and managing awarded funds; and,
WHEREAS, accepting Direct Awards and receiving Competitive Awards requires a local cash match based on formula.

Councilmember H. Miller commented, “I just wanted to reiterate what I said at the Finance Committee on the importance of this. Over the years the federal government used to fund this program. That’s the PRO officer at the high school, and the next resolution will be at the junior high school. The federal government used to support that with 90% funding. Now, I think it’s down to 48%, Valerie, close to that, 50%?”
Ms. Means commented, “Yes. A little bit less than 50%.”
Councilmember H. Miller commented, “And we’ve acted on it every year to continue to fund that important project for the community.”
Councilmember Moore commented, “The only thing I have to say is we saw their value earlier this year when there was an incident with a stray bullet striking the middle school. As a parent with students in the middle school, there is no end to the gratitude to those officers that I have, and I would fully support paying their entire salary to keep them in those schools. So, I would gladly pay for this contribution, although, I do have to admit one would think that those who fund these would fund them at a fuller rate, because there are bound to be municipalities and school districts who don’t have the ability to match those funds and provide for those officers. And, for those communities, it would be a great loss, and so it would for ours. So, I have nothing but total support for this program and the continuing of this funding.”
Mayor Miller commented, “Well said Councilman and I wanted to state that the arresting officer at that time was DNR Agent Steve Himmelrick. I did announce all the other contingency agencies that did assist the city police, and one of the councilmen wanted me to mention his name which I did do.”

TO ENTER INTO CONTRACT TO PROVIDE PREVENTION/RETENTION OFFICER (PRO) AT WEIR SENIOR HIGH SCHOOL FOR 2007 SCHOOL YEAR UTILIZING GRANT MONEY AVAILABLE THROUGH THE WEST VIRGINIA DIVISION OF CRIMINAL JUSTICE
WHEREAS, the City of Weirton has been notified by the WV Department of Military Affairs & Public Safety, Division of Criminal Justice Services of a federal appropriation spearheaded by the Honorable Senator Robert C. Byrd; and,
WHEREAS, Hancock County has also received a Direct Award; and,
WHEREAS, the Division of Criminal Justice Services has allowed and encouraged local Direct Award recipients to collaborate by pooling direct allocations and requesting additional funding through a Competitive Award process to fund projects that meet funding criteria and are within program areas; and,
WHEREAS, several Prevention/Retention Officer programs and similar School Resource Officer programs have been successfully implemented in the State of West Virginia and across the nation to address drug identification, gang identification, alcohol awareness, neglect and abuse prevention, and suicide and crisis prevention in the school system; and,
WHEREAS, the Weirton Police Department, the Hancock County Sheriff=s Department, the Hancock County Board of Education and the administrative personnel of Weir Senior High School have concluded that these funds would be used most effectively by developing/continuing a Prevention/Retention Officer (PRO) Program; and,
WHEREAS, the proposed PRO Program calls for a Weirton Police Department Officer to be reassigned as the Prevention/Retention Officer at Weir Senior High School; and,
WHEREAS, collaborative efforts and Competitive Award Applications under the Division of Criminal Justice’s Juvenile Justice and Delinquency Program (JJDP) must fall under one (1) jurisdiction; and,
WHEREAS, it has been determined that Hancock County and its Sheriff=s Department should be the jurisdiction responsible for making application and managing awarded funds; and,
WHEREAS, the Hancock County Sheriff=s Department and the Weirton Police Department will form the required Juvenile Crime Enforcement Coalition that will serve as the advisory and planning body; and,

Motion was made by Councilmember Veltri, second by Councilmember Moore.
Councilmember Moore commented, “This again continues this Council’s commitment to city-wide paving program that in my opinion would be unable to be completed without the municipal service fee that was enacted and dedicated to street repairs only. The total of this comes to…the general fund total comes to almost $763,000.00. I mean, (unintelligible), the budget, I have no idea where we would come up with $763,000.00. The paving budget that was in place when this council took office was under $200,000.00 from the general fund. I just have no idea that without the municipal service fee, where we would come up with nearly $800,000.00 to pave streets. And, I didn’t count them. I’m sure someone has. But, I have no idea. I’ve been through the budget a number of times, and I will take any suggestions where we’re going to find $800,000.00 to pave streets without the municipal service fee.”
Mayor Miller commented, “Councilman, I kind of agree with you whole heartedly. To give you a number of streets that have been paved in the last three years, including this, that would be 80 for the first 2 years at 2.4 million dollars, and now, the number right now, tonight, what we’re looking at is 38 more streets.”
Councilmember Moore commented, “And, I believe that we’re using the municipal service fee money as match for the Streetscape Grant on Penco Road which will allow us to leverage $160,000.00 into close to $1,000,000.00 in funds, and I don’t know where we would have come up with that money.”
Councilmember Dalrymple commented, “Perhaps if the State of West Virginia would get out of the Stone Age and give us more options to raise revenue other than hitting the citizens for it would be great. But, unfortunately, that’s not the case, and we have to do what we have to do to make sure that we have infrastructure in this community. Maybe the State will wake up one day, but I seriously doubt it.”
Councilmember Moore commented, “And, there’s a proposed development, am I correct, of 63 lots…”
That is correct, 40 to 60.”
Councilmember Moore commented, “40-60 potential new homes that will be based in the area which will be of access by Penco Road. So, the ability to have that turning lane placed at Elaine will be more thank necessary. You will have to have it because of the increased traffic that will be used to access those new homes.”
Mayor Miller commented, “And, we’ve contacted the Hancock County Commissioners for assistance on this, the whole project at Penco with the streetscape, our matching funds, that will be about over $2,000,000.00, and we’re having a tough time coming up with the other million, million more. So, essentially what you say is true. We have more people coming into the city. And, essentially we have to take care of the streets and we have to find the funding for it. So, if we look at the whole situation, and it’s true, we need some help with the funding of our infrastructure, and we hope to find it so that we can get Penco Road taken care of. Because, when you take a look at it, when it rains there, it’s like riding in a (unintelligible) craft as far as I’m concerned. It’s very unsafe, and I think everybody’s aware of that.”

TO ENTER INTO CONTRACT FOR CITY-WIDE MILLING AND PAVING
WHEREAS, it appears to be in the best interest of the City of Weirton that the City Manager be and is hereby authorized to enter into agreement for City-wide milling and paving; and,
WHEREAS, the Common Council of the City of Weirton did seek competitive bids; and,
WHEREAS, $83,350.00 of said bid shall be invoiced by the contractor to the City of Weirton=s Community Development Office for road improvements in surveyed low-moderate income areas under the Community Development Block Grant Program, with the actual amount being somewhat greater or lesser; and,
WHEREAS, $ 762,825.00 of said bid shall be invoiced to the City of Weirton General Fund for City-wide road improvements, with the actual amount being somewhat greater or lesser.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF WEIRTON, BROOKE AND HANCOCK COUNTIES, WEST VIRGINIA, that the City Manager be and is hereby authorized to enter into contract with CARL KELLY PAVING, INC., 4260 Freedom Way, Weirton, WV 26062 in an amount not to exceed Eight Hundred Fifty Thousand Dollars ($850,000.00) for said project.

Last November when we bought this truck, I wasn’t going to vote on buying this truck until we had a warranty, and I was told that we had a warranty, and extended warranty on this truck to find out that we didn’t have an extended warranty on the engine, so I’m going to vote for it. But, in the future, before I vote for anything like this again, I’m going to look and see that the extended warranty is in place before I vote.”
Mayor Miller commented, “Do you want to take that up with the gentleman that told you that he had the extended warranty?”
Councilmember Kondik commented, “Well, that’s water behind or whatever, but in the future, I will be looking the warranties before I vote on it.”
Councilmember Moore commented, “I guess, to be clear, Caterpillar is paying 60% of this repair, and we’re paying 40%, so apparently we’re still at some part under its manufacturer’s warranty. That’s why they’re…”
Mr. DuFour commented, “If I may, I think the consideration was that the engine seemed to have a major failure at very low miles. Their factory rep took the entire engine, all parts, took a look at it. I think that they gave us consideration because I think they believe that they have some liability and culpability in the failure of the engine. The engine itself freestanding would cost almost $18,000 before man hours to repair.”
Mayor Miller thanked the city manager.
Councilmember H. Miller commented, “I’d just like to say that we didn’t discuss this at the Finance Committee. Councilman Kondik’s right. We all anticipated that that warranty would be purchased. It was not purchased. (Unintelligible)

TO ENTER INTO CONTRACT FOR EMERGENCY REPAIRS TO CITY OF WEIRTON SANITATION TRUCK
WHEREAS, one of the City of Weirton’s sanitation trucks has been out of service due to required repairs to its engine; and,
WHEREAS, the cost for the estimated repairs for said engine will be shared between the City of Weirton (40%) and the Caterpillar manufacturing firm (60%); and,
WHEREAS, due to the fact that this sanitation truck has been out of service for several months, and is required for an efficient operation of the City of Weirton’s Sanitation Department, these repairs are being requested on an emergency basis.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF WEIRTON, BROOKE AND HANCOCK COUNTIES, WEST VIRGINIA, that the City Manager be authorized to enter into contract with Steubenville Truck Center, 620 South Street, P.O. Box 1741, Steubenville, OH 43952 in an amount not to exceed Seven Thousand Dollars ($7,000.00) for said repairs.
BE IT FURTHER RESOLVED THAT this amount shall include additional repairs which may be necessary.

A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF WEIRTON, WEST VIRGINIA, CERTIFYING THE AREA ENTITLED THE NORTHERN REDEVELOPMENT DISTRICT AS A BLIGHTED AREA IN ACCORDANCE WITH THE WEST VIRGINIA URBAN RENEWAL AUTHORITY LAW, AS AMENDED WHEREAS, the Redevelopment Authority of the City of Weirton in its planning efforts and the preparation of redevelopment plans for the City, has determined that an area north of the Downtown is in need of redevelopment assistance; and WHEREAS, the Redevelopment Authority of the City of Weirton has undertaken a study of the area which is designated as "The Northern Redevelopment District"; and WHEREAS, based on the existing conditions present in "The Northern Redevelopment District" it appears that the area meets some of the criteria outlined in the West Virginia Urban Renewal Authority Law for certification as a blighted area, which by reason of: o the predominance of defective or inadequate street layout; o faulty lot layout in relation to size, adequacy, accessibility or usefulness; o insanitary or unsafe conditions; o deterioration of site improvements; o diversity of ownership, tax or special assessment delinquency exceeding the fair value of the land; o defective or unusual conditions of title; o improper subdivision or obsolete plotting; o the existence of conditions which endanger life or property by fire and other causes; o substantially impairs or arrests the sound growth of the community; o retards the provision of housing accommodations; o constitutes an economic or social liability; o a menace to the public health, safety, morals, or welfare in its present condition and use.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF WEIRTON, BROOKE AND HANCOCK COUNTIES, WEST VIRGINIA, AS FOLLOWS:
SECTION 1. That the area entitled "The Northern Redevelopment District" contains some or all of the conditions which by definition constitute a "blighted area" in accordance with the West Virginia Urban Renewal Authority Law, as amended.

WHEREAS, the Lighthouse Domestic Violence Shelter has been fully operational since January of 2002 and has provided a valuable service to the community; and,
WHEREAS, CHANGE, Inc. has applied for an emergency shelter grant through the West Virginia Office of Economic Opportunity for funding; and,
WHEREAS, funding in the amount of fifteen thousand dollars ($15,000) shall be utilized to support the maintenance and operation of the Lighthouse Domestic Violence Shelter; and,
WHEREAS, the City of Weirton=s responsibility shall be to serve as a means of channeling the funding to the Shelter and will require no monetary support on the part of the City.

ADMINISTRATIVE REPORTS
Mr. Brown commented, “I’d like to thank you for your support on that engine. I believe that that truck is one of the biggest on our fleet, and it should be back in service this week. I thank you for your support. As a result, Councilman Kondik, of the warranty issues, I have staff looking into the warranties on the newer trucks on our fleet as a result of that meeting Thursday, the Finance Committee.”
Councilmember Kondik commented, “Thank you John.”
Mr. Brown commented, “We already hit the paving schedule. The auction at public works is on the 27th, viewing at 9:00, and the auction will start, the public auction at 10:00. This should get rid of a lot of debris and equipment at public works. Our crews are patching every day with cold patch. We have two crews out every day. Spring Clean Up 12th through 13th, white goods; 16th through 20th, regular household. The plant is anticipated to open for the hot patch around the middle of April, and we monitor that. Paving is scheduled for the 2nd or 3rd week of May, and after they pass the 9th I’m going to have the foreman contact him immediately and get that going. And, as far as the grass pickup Councilman, I’m willing to work to resolve that. I didn’t set that date.”
Councilmember Kondik commented, “Thank you.”
Mr. Mastrantoni commented, “I have noting further to report. I do want to say thank you for the support of the ATAD project. Council, I appreciate everything.”
Mayor Miller commented, “You’re more than welcome, and I’m glad you didn’t have to speak. Thank you Butch.”
Mr. Rekowski commented, “I’d like to announce that next week, April 16th through the 21st is National Library Week where all of the American libraries will be celebrating the significance of libraries in our communities. And, I would like to encourage everyone to come back to the library with their overdue books. It’s a fine free week. And, get a library card if you don’t have one, and become an information user.
Mr. Rosnick commented, Noting to add to the report, sir.”
Chief Cole commented, “Noting to add.”
Chief Scott commented, “Nothing additional sir.”
Mr. Weigel commented, “I do have one thing to add to the report. As you know, we ordered windows for the gymnasium and weight room of the Millsop Community Center. That project was made available in part through a Puglisi Grant and a Hancock County Savings Bank Grant that we have. I have talked with the contractor. Those windows are scheduled to be delivered late next week, and begin the installation of those, so both the weight room and the gymnasium windows. For those of you have been in the gym recently, you know how desperately in need those are to be replaced. So, I’m real happy that that project will be going. And, the way things look we should be beginning also the women’s locker room renovation project. So, we’ll have people up on the roof working, in the gymnasium replacing windows, and in the bottom floor renovating the women’s locker room so, it should be fun.”
Mayor Miller commented, “A sign of progress. You may have some irritated users.”
TREASURER’S REPORT
Valarie Means gave the treasurer’s report for March 2007, stating:
Beginning Cash Balance: 532,316.84 Interest: 1,869.87 Deposits: 1,217,837.35 Disbursements: 1,017,001.29 Ending Cash Balance: 735,022.77 Investment Balance: 1,302,256.75 Petty Cash Fund: 700.00 Total Cash and Investments Available: 2,037,979.52
Ms. Means commented, “You do have a few bills in your packet for approval. That total is $6,445.40.”
Motion was made by Councilmember Kondik to accept the financial reports, administrative reports and pay the bills, second by Councilmember Veltri.
Motion was carried by majority, 6/0.
ADJOURNMENT
With no further business before this April 09, 2007 regular session of the Weirton City Council the meeting was adjourned after the closing prayer.
